Terms & Conditions
These Terms & Conditions govern access to and use of the SenangJual marketplace by all visitors, users, buyers, sellers, vendors, advertisers, and other parties interacting with the platform.
1. Platform Nature
SenangJual operates as a marketplace platform that may allow users to create accounts, publish listings, browse products, submit inquiries, buy, sell, rent, promote, or negotiate goods, machinery, equipment, materials, and related business assets. Unless expressly stated otherwise, SenangJual generally acts as an intermediary platform and is not automatically a contracting party to transactions between users.
2. Acceptance of Terms
By accessing, registering, listing, inquiring, or using any part of SenangJual, you agree to be bound by these Terms & Conditions and any related policies published on the platform, including the Privacy Policy.
3. Eligibility and Accounts
Users must provide accurate and current information when registering and must keep login credentials secure. SenangJual may suspend, verify, restrict, or remove accounts where information appears false, misleading, incomplete, abusive, unlawful, or risky to platform integrity.
4. Listings and Seller Responsibility
Sellers and vendors are solely responsible for the legality, ownership, condition, pricing, descriptions, warranties, availability, claims, images, and supporting information in their listings. Listings must not be deceptive, infringing, unlawful, or materially misleading.
5. Buyer Responsibility
Buyers and inquiring users are responsible for reviewing listing details, inspecting where appropriate, confirming specifications, checking commercial terms, and carrying out their own due diligence before making commitments, deposits, payments, or arrangements.
6. Marketplace Communications
SenangJual may provide contact forms, inquiry tools, vendor contact pathways, or messaging-related functions to support communication between users. Users must use these functions lawfully, respectfully, and only for legitimate marketplace purposes.
7. Prohibited Conduct
Users must not use the platform to upload false or stolen content, impersonate others, infringe intellectual property rights, distribute malware, interfere with platform operations, scrape protected content, post prohibited goods or services, or engage in fraud, unlawful trade, harassment, or abusive conduct.
8. Payments, Delivery, and Commercial Terms
Unless SenangJual expressly operates a payment or escrow function, transaction pricing, deposits, delivery, returns, inspection arrangements, taxes, shipping, insurance, and final commercial terms are matters between the relevant parties. Users should document important commercial terms clearly.
9. Consumer and E-Commerce Expectations
SenangJual expects users to act consistently with applicable consumer protection, e-commerce, trade description, and fair dealing requirements. Where Malaysian law applies, users are expected to comply with relevant statutory duties, including those affecting online trade disclosures, accuracy of representations, and consumer rights.
10. Intellectual Property
The SenangJual name, branding, site design, layout, graphics, and platform materials are protected to the extent permitted by law. Users retain rights to their own lawful content but grant SenangJual a non-exclusive right to host, display, reproduce, format, and distribute submitted content for marketplace operation, moderation, and promotion of the listing or platform.
11. Moderation and Enforcement
SenangJual may review, edit, reject, de-index, suspend, or remove listings, accounts, or content where this is reasonably required for compliance, quality control, fraud prevention, safety, legal risk management, or protection of users and the platform.
12. No Guarantee and Service Availability
SenangJual does not guarantee uninterrupted access, listing visibility, ranking, sales results, rental results, inquiry volume, error-free operation, or transaction completion. Platform features may change, be restricted, or be discontinued from time to time.
13. Limitation of Liability
To the maximum extent permitted by law, SenangJual will not be liable for indirect, incidental, consequential, special, reputational, or business losses, or for disputes, misrepresentations, defects, delays, delivery issues, non-payment, or other conduct by users or third parties. Nothing in these terms is intended to exclude liability that cannot lawfully be excluded.
14. Indemnity
You agree to indemnify and hold SenangJual harmless from claims, liabilities, costs, or losses arising from your content, listings, misuse of the platform, breach of these terms, infringement allegations, or unlawful conduct.
15. Termination or Suspension
SenangJual may suspend or terminate access, remove content, or restrict marketplace functions at any time where reasonably necessary for platform integrity, breach management, compliance, abuse prevention, or business operations.
16. Governing Law
Unless otherwise required by mandatory law, these Terms & Conditions are intended to be governed by the laws of Malaysia. Users accessing the platform from other jurisdictions remain responsible for complying with local laws applicable to them.
17. Changes to Terms
SenangJual may revise these Terms & Conditions from time to time. The latest revision date is 27 April 2026. Continued use of the platform after updates may constitute acceptance of the revised terms.
